Terms of Service

These Terms of Service ("Terms") govern your use of the Arcus mobile application ("App") operated by Next Frame Innovations LLC ("we," "us," or "our"). By downloading, installing, or using Arcus, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Arcus, you confirm that you are at least 13 years old and agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Description of Service

Arcus is an AI-powered fitness application that provides:

• Personalized workout program generation
• Exercise tracking and progress logging
• Periodized training plans
• Integration with health devices and Apple HealthKit

3. Not Medical Advice

Arcus is a fitness tool, not a medical device. The workout programs, exercise recommendations, and fitness guidance provided by Arcus (including AI-generated content) are for informational and educational purposes only. They do not constitute medical advice, diagnosis, or treatment.

You should:

• Consult a qualified healthcare provider before starting any exercise program, especially if you have pre-existing health conditions, injuries, or concerns
• Stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or other concerning symptoms
• Use your own judgment about the safety and appropriateness of any exercise

You assume all risk associated with your use of Arcus and any exercise programs generated by the App.

4. Account Registration

To use Arcus, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity under your account

5. Subscriptions and Payments

Arcus may offer subscription-based access to premium features. If you purchase a subscription:

• Payment is charged to your Apple ID account at confirmation of purchase
• Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
• You can manage and cancel subscriptions in your device's Settings > Apple ID > Subscriptions
• No refunds are provided for partial subscription periods

We reserve the right to change subscription pricing. Price changes will not affect your current billing period and will take effect at the next renewal.

6. AI-Generated Content

Arcus uses Anthropic's Claude AI to generate workout programs. You acknowledge that:

• AI-generated workout programs are recommendations, not guarantees of results
• AI-generated content may occasionally contain errors or suboptimal recommendations
• You are responsible for evaluating the safety and appropriateness of any AI-generated workout for your individual circumstances
• De-identified fitness data (goals, experience level, equipment, restrictions) is sent to Anthropic for program generation as described in our Privacy Policy

7. Acceptable Use

You agree not to:

• Use Arcus for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's functionality or servers
• Create multiple accounts or share account credentials
• Use automated tools, bots, or scrapers to access the App
• Redistribute, sublicense, or resell access to Arcus

8. Intellectual Property

All content, features, and functionality of Arcus (including design, code, graphics, logos, and exercise descriptions) are owned by Next Frame Innovations LLC and protected by copyright, trademark, and other intellectual property laws.

Your workout data and personal information remain your property. By using Arcus, you grant us a limited license to process this data solely for providing the service.

9. Third-Party Integrations

Arcus integrates with third-party services including Apple HealthKit, WHOOP, Garmin, Polar, Oura, and Fitbit. These integrations are governed by the respective third party's terms of service. We are not responsible for the availability, accuracy, or functionality of third-party services.

10. Disclaimer of Warranties

Arcus is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Workout programs will produce specific results
• AI-generated content will be free from errors
• The App will be compatible with all devices or operating systems

11. Limitation of Liability

To the maximum extent permitted by applicable law, Next Frame Innovations LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Personal injury or physical harm resulting from exercise
• Loss of data or profits
• Service interruptions
• Any damages arising from your use of or inability to use the App

Our total liability for any claim arising from your use of Arcus shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Next Frame Innovations LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of Arcus or violation of these Terms.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time by contacting support@arcus.training.

Upon termination, your right to use Arcus ceases immediately. Data deletion will be handled in accordance with our Privacy Policy.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the State of Florida.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of Arcus after changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
